Subcommittee on Highways and Transit - Drug and Alcohol Testing of Commercial Motor Vehicle Drivers
The Committee on Transportation and Infrastructure will meet on Thursday, November 1, 2007 at 10:00 a.m., in 2167 Rayburn House Office Building, to receive testimony regarding vulnerabilities in the Drug and Alcohol Testing (DAT) programs administered by motor carriers. The Oversight and Investigations staff has conducted an in-depth review of conditions at facilities that perform urine collections for drug tests regulated by the Department of Transportation (DOT). The hearing will examine weaknesses in the collection process that could allow drug-using commercial drivers to disguise their drug use. We will identify the extent to which those products manufactured and sold specifically to beat drug tests affect the integrity of the drug testing process. Finally, the hearing will explore factors that enable drug-using drivers to continue to operate commercial motor vehicles and potential solutions to the identified weaknesses

FAA Clarifies Drug and Alcohol Testing for Contractors
The Federal Aviation Administration this week published a Final Rule clarifying that each person who performs a safety-sensitive function for a regulated employer by contract, including by subcontract at any tier, is subject to testing.

FAA Extends Compliance Date for Regulations Concerning Subcontractors at Any Tier
In a notice published on April 5, 2006, the FAA announced that it is delaying the compliance date for the final rule clarifying that contractors, including subcontractors at any tier, must be subject to drug and alcohol testing. The FAA indicated in the extension that this action is necessary because it has come to their attention that some original equipment manufacturers (OEMs) and other entities may be confused regarding whether they are performing maintenance or preventive maintenance duties subject to drug and alcohol testing, or manufacturing duties not subject to testing. The effective date of April 10, 2006, will remain the same, but this action by the FAA extends the compliance date until October 10, 2006, which gives OEMs and others sufficient time to determine what work is subject to drug and alcohol testing.

The Drink Wheel
The Intoximeters Inc. "Drink Wheel"1 is a form that you can fill out that when completed will instantly compute your estimated blood/breath alcohol concentration ("BAC") or blood alcohol content. This simulates the breath alcohol testing done by an Intoximeter Alco-Sensor IV. The Alco-Sensor IV is used in both Law Enforcement and Workplace Testing for alcohol testing.
